Charter Parties

PURPOSE AND USE

Form Profile:

This form is a written contract between the owner of a vessel and a shipper (Charterers) to engage the use of all or part of the vessel to call at a specified port to load the Charterers' cargo and deliver it to a specified destination port or ports. It is essentially like renting or hiring a vessel or space on a vessel to transport goods. The contract details various conditions of transport and delivery and the responsibilities of each Charter Party, including the freight rate and when it is payable. There are specialized forms for various commodities and conditions.

Vessels available for charter are not normally part of a scheduled steamship line fleet. International Letters of Credit forbid the use of Charter Party unless specifically stipulated in the credit. There are a variety of charter party agreements, such as Gencon (Baltic/White Sea), and Tanker Voyage. They are regulated and approved by their respective agencies or associations.

Baltimore Berth Grain Form C 1913

Form Profile:

The Baltimore Berth Grain was designed for the shipment of grain from North American ports to Europe. The form includes “Berth Terms” containing requirements regarding the number of days allowed for loading of the vessel before demurrage charges commence. Also, the charter terms call for similarly worded bills of lading implying that loading and discharge expenses are borne by the corresponding bills of lading since the charter terms call for similarly worded bills. These terms are also called “Liner Terms” because the charter parties using them are often contracted with conference lines making regularly scheduled sailings.

Americanized Welsh Coal Charter 1993 (AMWELSH 93)

Form Profile:

The AMWELSH 93 is used for the shipment of coals from U.S. ports to all destination ports. It is also commonly used for the shipment of petroleum coke from the U.S. Gulf and Western ports to worldwide destination ports. The 93 version has additional terms related to dispute resolution. AMWELSH 93 is approved by the Baltic and International Maritime Council (BIMCO) and the Association of Ship Brokers and Agents (ASBA).

Form Profile:

The AMWELSH 79 is an earlier version of AMWELSH 93. It is also used for the shipment of coals from U.S. ports to all destination ports. AMWELSH 79 is approved by the Baltic and International Maritime Council (BIMCO).

Vegoilvoy Tanker Voyage Charter 1950 (VEGOILVOY 1950)

Form Profile:

This form is used for the shipment of petroleum and vegetable oil products in tank vessels. It also includes a bill of lading as part of the charter terms. VEGOILVOY contains many specific clauses relative to this specific type of cargo. It also contains ample space for the parties to itemize special provisions unique to tank vessels including the preamble, vessel description area, and freight terms and rates.

New York Produce Exchange Time Charter 1993 (NYPE 93)

Form Profile:

The NYPE 93 charter party form was originally created for produce. Its principal use is now for general cargo other than bulk cargo and other than bulk liquid cargo. It is comprehensive and has been revised to add clauses commonly used as riders in previous evolutions to include issues such as Anti Drug Abuse and Stowaways. This form is approved by the Baltic and International Maritime Council (BIMCO) and Association of Ship Brokers and Agents (ASBA).

Form Profile:

This is a widely used form which offers as a feature a free in and out (f.i.o.) clause. This addresses the responsibility of the charterers to load, or the consignees to discharge or unload the cargo. The form also features additional text for the United States in the General Average clause and clarification on responsibilities for duties and taxes. The form is approved by the Baltic and International Maritime Council (BIMCO) and the Association of Ship Brokers and Agents (ASBA).

Tanker Voyage Charter 1977 (ASBATANKVOY 77)

Form Profile:

The ASBATANKVOY 77 is the most widely used charter form for the petroleum trade. It features special clauses addressing issues unique to tankship operations such as cleaning of tanks, pipes, and pumps. It also addresses the prohibition of general cargo and the requirement to carry only liquid bulk cargo. The form is approved by the Association of Ship Brokers and Agents (ASBA).

Form C. (ORE) 1974

Form Profile:

The C. (Ore) is also known as the Mediterranean Iron Ore Charter Party form. It is another example of a cargo specific charter. It is used with Ore Carriers or multipurpose ore / bulk cargo vessels.

North American Grain Charter 1989 (NORGRAIN 89)

Form Profile:

The NORGRAIN 89 is a type of voyage charter party form specially designed to cover shipments of grain products from United States and Canadian ports. This form addresses the unique issues related to the shipment of this type of commodity. It includes special clauses referencing Time of Notice, Fumigation, Shifting, Laytime, and inspection clauses for Grain Cargo Certificates. The form also includes updated clauses on General  Average, Water Pollution, Ice, and Arbitration. The form is approved by the Baltic and International Maritime Council (BIMCO).

PURPOSE AND USE

Form Profile:


This document is used to tell the Customs broker at the destination port what method of inland transportation is to be used to transport the goods from the entry port to the buyer's place of business. This form is also used occasionally to transfer title from one broker to another.

Avoid These Common Errors
Delivery Order
Authorizes the release of the cargo from an airline or stevedore, so Bill of Lading instructions must be clearly and accurately referenced on this form so that the goods can be quickly and easily identified once they reach the destination port. 

Dock Receipt 

PURPOSE AND USE

Form Profile:

This form is used to provide the shipper/exporter with proof that the goods have been delivered to the carrier in good order. The dock receipt is usually prepared by the freight forwarder and is required to be acknowledged by the carrier. Title to the goods is not conveyed since this is designated as a “non negotiable” form.

Avoid These Common Errors
Dock Receipt

Usually prepared using information from the Bill of Lading. However, instructions which do not appear on the Bill of Lading (such as whether the goods must be held on the dock, routing information, etc.) must appear on the Dock Receipt. 











Delivery Instructions / Dock Receipt

PURPOSE AND USE

Form Profile:

This form combines instructions to the common carrier for  delivery to a particular vessel or port and a dock receipt verifying to the shipper that the goods have been delivered in good order. It  allows for completion of both ducments at the same time.
