NAFTA Certificate of Origin

PURPOSE AND USE

Form Profile:

The North American Free Trade Agreement (NAFTA) allows substantial benefits for importers and exporters in Mexico, Canada, and the United States for goods originating in the three nations. These benefits of Customs duty reduction and elimination depend upon an exporter's declaration of the origin of the goods using the NAFTA Certificate of Origin to do so. This certificate must be completed by the U.S. exporter and must be in the possession of the Mexican or Canadian importer at the time the declaration is made to the appropriate customs agency.

The U.S. importer is responsible for determining the eligibility of goods for NAFTA preference and for providing the importer with the certificate. A NAFTA Certificate of Origin may be prepared for a single product of a one time shipment or as a Blanket Certificate for multiple shipments of identical items for a time period of up to one year.

The exporter must determine the appropriate Rule of Origin for the goods. These six Rules are detailed in Chapter 4 of Annex 401 of the Agreement and cover items wholly produced in North America, those having contents or components which have been sufficiently changed by rule through production in North America , those which have sufficient Regional Value Content, or are listed in Annex 300 under certain Tariff Preference Levels.

Common Errors to Avoid:
  • Block 1 – EIN or IRS number omitted
  • Block 5- Description on C/O and Commercial Invoice do not match
  • Block 7- Incorrect Preference Criteria due to misinterpretation of applicable Rule of Origin
  • Block 11 – No signature
