Charter Party agreements are written contracts
between the owner of a vessel and a
shipper (Charterers) to engage the use of all or part of the vessel to
call at a specified port to load the Charterers' cargo and deliver it
to a specified destination port or ports. It is essentially like
renting or hiring a vessel or space on a vessel to transport goods. The
contract details various conditions of transport and delivery and the
responsibilities of each Charter Party, including the freight rate and
when it is payable. There are specialized forms for various commodities
and conditions.
Vessels available for charter are not normally part of a
scheduled
steamship line fleet. International Letters of Credit forbid the use of
Charter Party unless specifically stipulated in the credit. There are a
variety of charter party agreements, such as Gencon
(Baltic/White
Sea), and Tanker Voyage. They are regulated and approved by
their
respective agencies or associations.

Purpose and Use:
The Baltimore Berth Grain was designed for the shipment of grain from North American ports to Europe. The form includes “Berth Terms” containing requirements regarding the number of days allowed for loading of the vessel before demurrage charges commence. Also, the charter terms call for similarly worded bills of lading implying that loading and discharge expenses are borne by the corresponding bills of lading since the charter terms call for similarly worded bills. These terms are also called “Liner Terms” because the charter parties using them are often contracted with conference lines making regularly scheduled sailings.
